1. Introductory provisions

The business terms given below apply exclusively to purchases made in the internet shop at www.unitedmusic.cz. This internet shop is operated by UM Events s.r.o. The correspondence address is UM Events s.r.o., Českomoravská 2345/17, 190 93 Prague 9 (hereinafter referred to as the Seller). These business terms specify and defined the rights and duties of the Seller and the Client making a purchase in the internet shop at www.unitedmusic.cz (hereinafter referred to as the Buyer).

2. Delivery deadline

Following confirmation of the order by e-mail the order is considered valid and filed by the Seller. Merchandise is shipped within 2 – 3 working days. If the Seller is unable to ship the merchandise within this time limit, it is required to contact the Client. Česká pošta, s. p. (Czech Mail) is liable for final delivery of the merchandise.

3. Carriage and payment

The Seller utilises the services of Česká pošta, s. p. for sending the merchandise. The merchandise is shipped as a commercial parcel/payment on delivery. When shipping payment on delivery the Seller will charge a postage fee in the sum of 100 CZK.

4. Placing an order and conclusion of a sales contract

  1. All orders placed by means of the internet shop at www.unitedmusic.cz are binding. By placing an order the Buyer confirms that he/she has been acquainted with these business terms including the terms for complaints and that he/she agrees with these.
  2. The order is a draft of the sales contract. The sales contract is concluded at the moment the ordered merchandise is accepted by the Buyer.
  3. Validity of the electronic order is conditional to entry of all the data and prerequisites prescribed by the form.
  4. The site of delivery of the merchandise is the Buyer’s address given in the registration form.
  5. The ownership title to the merchandise is transferred to the Buyer, under the condition of payment of the sales price, on receipt of the merchandise.
  6. By completing the registration form, or placing a binding order within the scope of the internet shop at www.unitedmusic.cz, the Buyer gives his/her consent to the Seller to compile and archive personal data about the Buyer and his/her purchases.
  7. The Seller declares that all merchandise offered within the scope of the internet shop at www.unitedmusic.cz originates from warehouses of official manufacturers and importers.
  8. Prices given in the price list are final.
  9. The Seller reserves the right to refuse to satisfy an order if the ordering data is incomplete, or if it gives rise to doubt regarding the client’s actual intent to order the merchandise. The Seller will send information about this refusal to the Buyer’s e-mail address.

5. Withdrawal from the Sales contract (returning merchandise)

According to Section 53, paragraph 6 of Act no. 40/1964 Coll., of the Civil Code as amended, the Buyer is entitled to withdraw from the Contract without giving a reason within 14 days of receipt of the merchandise. If the Buyer decides to do so, he/she must return the undamaged merchandise, without traces of use or wear, in the original packaging, within the specified time limit (the date of sending is decisive). After receipt of the returned merchandise the Seller will immediately refund the appropriate sum to the Buyer by the previously arranged method. The Buyer cannot withdraw according to Section 53, paragraph 7 of Act no. 40/1964 Coll., of the Civil Code as amended from the Sales Contract for delivery of merchandise modified according to the Buyer’s wishes or for his person, or for merchandise that is subject to rapid decomposition, wear or obsolescence.

Merchandise returned by mail payment on delivery will not be accepted!

6. Final provisions

  1. These business terms apply in the wording given on the Seller’s internet pages on the day the electronic order is sent by the Buyer.
  2. By sending the electronic order the Buyer accepts all the provisions of these business terms as amended and valid on the day the order is sent, without reservations, and also accepts the price of the ordered merchandise valid on the day of sending including the postage fee given in the catalogue in the internet shop at www.unitedmusic. cz, unless provably agreed otherwise in specific cases. The Buyer is irreversibly bound by the sent order.
  3. The Buyer may cancel the order without the Seller’s consent within 24 hours of placing the order at the latest, or after the delivery deadline confirmed in writing by the Seller is exceeded. In other cases the Buyer must come to an agreement with the Seller.
  4. The Seller and the Buyer have expressly agreed, in accordance with the provisions of Section 262 paragraph 1 of Act no. 513/1991 Coll., of the Commercial Code as amended, that unless the terms expressly state otherwise, their rights and duties are governed by the generally valid Czech Republic legislation, as specified in the Collection of Laws, chiefly Act no. 40/1964 Coll., of the Civil Code and Act no. 513/1991 Coll., of the Commercial Code.
